Opposing counsel filed a Motion to Dismiss our client’s Custody/Visitation Petition based on res judicata in Suffolk County Family Court. After our firm filed opposition papers, the judge ruled in our client’s favor, holding that the Petition shall not be dismissed because Custody/Visitation Orders are not entitled to res judicata effect and are subject to modification.
